    DOES THIS SOUND FAMILIAR?

A Single Error on Your Checkr Report Can Take Away Your Livelihood

Checkr runs background checks for hundreds of companies — including Uber, Lyft, DoorDash, Amazon Flex, and traditional employers. When their automated systems make a mistake, you pay the price.

    🚗

Your Uber, Lyft, or DoorDash account was deactivated after a Checkr background check — even though you did nothing wrong

    💼

A job offer was rescinded or you were passed over for employment because of inaccurate information on your Checkr report

    🚫

A criminal charge that was dismissed, expunged, or never yours is still showing up as a conviction on your report

    🆔

Someone else's criminal record is appearing on your background check because of a name match, birthdate error, or mixed file

    📋

Checkr listed a misdemeanor as a felony, or showed a pending charge as a conviction — and you were denied based on that error

    📬

You disputed the error directly with Checkr — and they came back with "verified" without actually fixing anything

If any of these apply to you, you likely have a viable case under the Fair Credit Reporting Act — and you're entitled to legal representation at no cost.
    The Process

Three Steps to Challenging Your Checkr Report

We handle everything. You focus on getting back to work.

    1

    We Review Your Checkr Report

Share your Checkr background check report with us (or we’ll help you request it). Our team reviews every entry for inaccurate records, misclassified offenses, mixed files, expunged charges, and other FCRA violations that may have cost you work or income.

    2

We Can Assist With a Formal Dispute

If your case calls for it, our attorneys can help prepare and submit a formal dispute to Checkr on your behalf. Under the FCRA, Checkr has 30 days to conduct a genuine investigation. We build a thorough, documented case — not a generic form letter — and preserve the full record in case further legal action becomes necessary.

    3

If the Errors Aren't Fixed, You May Be Owed Compensation

If Checkr fails to properly investigate or refuses to fix a legitimate error, you may have grounds for a federal lawsuit. We can pursue monetary damages for your lost wages, lost opportunities, and other harm caused by their violation. You owe us nothing directly either way.

What Checkr Is Required to Do — and Often Doesn't

    Checkr's FCRA Obligations

The Fair Credit Reporting Act places strict requirements on background check companies. When Checkr violates these rules, you have the right to sue.

    Accuracy Requirements

Checkr must follow "reasonable procedures to assure maximum possible accuracy." Automated systems that produce mixed files, outdated records, or misclassified offenses violate this standard.

    Dispute Investigation

When you dispute an error, Checkr has 30 days to conduct a genuine investigation — not just confirm the original data. Rubber-stamping inaccurate records as "verified" is an FCRA violation.

    Adverse Action Notices

Before any employer or platform takes adverse action against you based on a Checkr report, they must provide you with a pre-adverse action notice and a copy of the report. Skipping this step is a separate FCRA violation.

    Reportable Information Limits

Checkr cannot report arrests without conviction, expunged records, or certain old records. Including non-reportable information on your background check is itself a federal violation.

    Know Your Rights

The Law Is on Your Side — Most People Just Don't Know It

The Fair Credit Reporting Act (FCRA) is a federal law that governs how background check companies like Checkr must collect, report, and investigate consumer information. When Checkr violates the FCRA — whether by reporting inaccurate records, failing to properly investigate a dispute, or including non-reportable information — they can be held legally liable.

That means you may be entitled to:

    • 💵
Actual DamagesMoney lost from denied credit, higher interest rates, or other financial harm
    • 📋
Statutory DamagesUp to $1,000 per violation — even without proving a specific financial loss
    • ⚖️
Punitive DamagesAdditional amounts a court may award if the violation was willful
    • 🏛️
Attorney’s FeesPaid by the credit bureaus and the companies that furnished the inaccurate information — not directly by you

    ★★★★★

"I went to Mr. Kim for help about two years ago and he immediately agreed to assist me with my credit report and creditors. He went to work and his legal assistant is amazing and very responsive. They showed that they cared, and in the end I was rewarded for all my issues — my credit score is now 741 thanks to Mr. Kim and his paralegal Anna. I will be forever grateful and will 100% recommend them to anyone with any credit or creditor problems."

"I was frustrated by the mistreatment of a creditor that damaged my credit. I filed a dispute with the credit agencies hoping it would resolve my issue — their process is a joke; it's as if they just work for the creditors. That's when I decided to hire The Kim Law Firm. Mr. Kim did an excellent job fighting for my rights, clearing up my credit, and getting compensation for my aggravation. If you need help, this is the firm you want representing you."

He was confident he could help me from the very beginning, and in the end he did just that and more. My experience could not have been better. I sincerely thank you all for advocating on my behalf and seeing me when other entities did not."

    Common Questions

    Frequently Asked Questions

Yes. Under the Fair Credit Reporting Act, you have the right to dispute any inaccurate information on your Checkr report. Checkr is required to investigate your dispute within 30 days. If they fail to correct a legitimate error, you may have grounds to pursue legal action. An attorney can help you file the dispute correctly and preserve your legal options.
Platform deactivation due to a Checkr error is one of the most common and damaging outcomes we see. Lost gig income counts as actual damages under the FCRA — meaning you may be entitled to compensation for the wages you lost while your account was deactivated. Contact us as soon as possible; the sooner we begin documenting your income loss, the stronger your case.
Before any employer or platform takes adverse action against you based on a background check — such as rescinding a job offer or deactivating an account — they are required under the FCRA to provide you with a pre-adverse action notice and a copy of the Checkr report. If you were denied or deactivated without receiving this notice, the employer or platform may have committed a separate FCRA violation.
Checkr has 30 days from receipt of your dispute to complete its investigation and notify you of the results. In limited circumstances this can extend to 45 days. If Checkr exceeds this window, fails to investigate properly, or reconfirms inaccurate information without adequate review, those failures may constitute additional FCRA violations that strengthen your legal claim.
Nothing out of pocket. Under the FCRA, if Checkr is found to have violated the law, they are required to pay your attorney's fees. Our legal fees are paid by Checkr and the responsible parties — not by you. There is no retainer, no hourly charge, and no bill at the end. If we don't win, you don't pay.
Mixed-file errors — where another person's record appears on your background check due to a similar name, shared address, or birthdate error — are among the most serious FCRA violations because they can be difficult to correct through Checkr's standard dispute process. We know how to document and pursue these cases, including when the error persists after an initial dispute.
