Chrysler Capital Credit Report Errors

The Kim Law Firm represents consumers whose auto loans are being reported inaccurately by Chrysler Capital. If Chrysler Capital is reporting a balance you already paid, a repossession that did not happen the way it claims, an account that was discharged in bankruptcy, or a loan that is not even yours, the Fair Credit Reporting Act gives you the right to force a correction and to recover money for the harm a false auto-loan tradeline causes. This page explains who Chrysler Capital is, how to reach it, and what to do if the account on your credit report is wrong.

Who is Chrysler Capital?

Chrysler Capital is the auto-financing brand operated by Santander Consumer USA, the nation's largest subprime auto lender, under an agreement to finance vehicles at Chrysler, Dodge, Jeep, and Ram dealerships. When you finance through Chrysler Capital, Santander Consumer USA is the company that services the loan and reports it to the credit bureaus.

Is Chrysler Capital reporting your auto loan incorrectly?

Because Chrysler Capital reports your account to the credit bureaus every month, an error on its tradeline can drag your score down for years. The most common inaccuracies we see on auto-loan accounts include:

  • A balance you already paid. The loan was paid off, settled, or covered by a total-loss insurance payoff, but Chrysler Capital still reports a balance or past-due amount.
  • A wrong or duplicated repossession. A repossession reported incorrectly, an overstated deficiency balance, or the same repossession reported more than once.
  • A debt discharged in bankruptcy. The account was discharged, yet it still reports a balance or keeps showing as past due.
  • Re-aging. The date of first delinquency is moved forward so a negative account stays on your report longer than the seven years the law allows.
  • It is not your account. Identity theft or a mixed credit file can put a Chrysler Capital auto loan you never opened on your report.

Each of these is a potential violation of the Fair Credit Reporting Act (FCRA), which can entitle you to have the item corrected or deleted and to recover damages, often at no cost to you.

How to contact Chrysler Capital

Chrysler Capital is operated by Santander Consumer USA, based in Dallas, Texas, and its customer-service line is 1-855-563-5635 (website: chryslercapital.com). Confirm the correct dispute or payoff address on your most recent statement before mailing, and send written disputes by mail.

Chrysler Capital and consumer-protection law

In 2020, Santander Consumer USA, which operates Chrysler Capital, agreed to a $550 million settlement with 34 state attorneys general over deceptive subprime auto-lending practices that exposed consumers to an unnecessarily high risk of default. The Consumer Financial Protection Bureau has separately taken action against Santander over its consumer-reporting and add-on practices. Source: Consumer Financial Protection Bureau. If your Chrysler Capital tradeline is inaccurate, you have strong grounds to demand a correction.

Who we can help and who we can not

We represent consumers whose Chrysler Capital auto loan is being reported incorrectly — a balance that was already paid, a repossession or bankruptcy reported wrong, or an account that is not yours because of identity theft or a mixed file. That is the kind of Fair Credit Reporting Act problem we handle. We are not the right firm if you simply want out of a car loan you genuinely owe, want to lower a legitimate payment, or want to stop a lawful repossession of a vehicle you financed and stopped paying for. Our focus is fixing inaccurate reporting and recovering damages for the harm it causes.

How The Kim Law Firm helps

If you disputed a Chrysler Capital account and it was not fixed, or the damage is already done, we can help. Under the FCRA, Chrysler Capital and the credit bureaus must conduct a genuine investigation of your dispute; when they rubber-stamp an error instead, they can be held accountable for actual damages, statutory damages, and your attorney's fees. The FCRA lets us recover our fees from the company that broke the law, so your case review is free and we work on a no-fee-unless-we-win basis. A financing brand is not a lending company

Manufacturers put their own names on financing programs that other companies actually run. The showroom experience is seamless and the branding is consistent, so the buyer reasonably believes they borrowed from the carmaker. The credit report tells a different story, and the difference matters the moment something needs correcting, because the obligation to investigate belongs to whichever entity furnished the entry.

  • Santander Consumer USA — the company servicing and reporting the accounts sold under this brand, and a furnisher with a consent order of its own from December 2020.
  • Stellantis Financial Services — the manufacturer's own captive arm for the same vehicle brands, built out of First Investors in November 2021.
  • TD Auto Finance — a third lender commonly financing the same models, reporting as TDAF or TD Auto Fin.
  • America's Car-Mart — a retail name whose accounts are furnished by Colonial Auto Finance.
  • Byrider and CNAC — the same split at the buy here pay here end of the market.

Read the furnisher name off the report rather than off the brochure, then verify it against your contract before writing to anyone. If the report names a company your paperwork never mentions and the account details do not match either, that is a different problem from a branding mismatch, and it should be raised as a possible mixed file rather than as an ordinary accuracy dispute.

Frequently asked questions about Chrysler Capital

Can I get Chrysler Capital removed from my credit report?

If the tradeline is inaccurate — wrong balance, a repossession or bankruptcy reported incorrectly, re-aged dates, or not your account — you can dispute it with all three credit bureaus and directly with Chrysler Capital under the FCRA. Anything that cannot be verified must be corrected or deleted.

Chrysler Capital is reporting a balance after my car was repossessed or totaled. Is that allowed?

Only if the amount is accurate. Overstated deficiency balances, amounts already paid by insurance, and balances discharged in bankruptcy are common errors you can challenge.

The account is not mine.

If a Chrysler Capital loan appears on your report because of identity theft or a mixed file, do not pay it — dispute it, and if it is not corrected our attorneys can pursue the bureaus and Chrysler Capital under the FCRA.

What does it cost to have my case reviewed?

Nothing. The FCRA shifts attorney's fees to the company that broke the law, so we offer a free case review and work on a no-fee-unless-we-win basis.
