    HireRight's FCRA Obligations

    The Fair Credit Reporting Act places strict requirements on background check companies. When HireRight violates these rules, you have the right to sue.

    Accuracy Requirements

    HireRight must follow "reasonable procedures to assure maximum possible accuracy." Automated systems that produce mixed files, outdated records, or misclassified offenses violate this standard.

    Dispute Investigation

    When you dispute an error, HireRight has 30 days to conduct a genuine investigation — not simply reconfirm the original data. Rubber-stamping inaccurate records as "verified" is an FCRA violation.

    Adverse Action Notices

    Before any employer takes adverse action based on a HireRight report, they must provide you with a pre-adverse action notice and a copy of your report. Skipping this step is a separate FCRA violation.

    Reportable Information Limits

    HireRight cannot report arrests without convictions, expunged records, or certain older records. Including non-reportable information on your background check is itself a federal violation.

    Under the FCRA, you are entitled to a copy of any background check report used against you. If an employer took adverse action based on a HireRight report, they were required to provide you a copy before doing so. You can also request your consumer file directly from HireRight through their consumer center. We can assist you with this process as part of your case review.
    Common HireRight errors include: mixed files where another person's criminal or civil records appear on your report, misclassified offenses (such as a misdemeanor reported as a felony), charges that were dismissed or expunged still appearing as convictions, outdated records that are no longer legally reportable, inaccurate employment or education history, and duplicate entries listing the same incident more than once.
    Before any employer takes adverse action against you based on a HireRight report — such as withdrawing a job offer — the FCRA requires them to provide you with a pre-adverse action notice and a copy of the report. This gives you a chance to review and dispute any errors before a final decision is made. If you did not receive this notice, the employer may have committed a separate FCRA violation you can act on.
    HireRight has 30 days from receiving your dispute to conduct a proper investigation and notify you of the results (45 days in certain circumstances). If they exceed this window, fail to conduct a genuine reinvestigation, or reconfirm inaccurate information without adequate review, those failures may constitute additional FCRA violations and strengthen your legal claim significantly.
    A final adverse employment decision does not end your legal rights. Lost wages and lost employment opportunities are recoverable as actual damages under the FCRA.
