What Is VeriFirst? Employment and Tenant Background Checks — and Your Rights When the Report Is Wrong

If an employer, a landlord, or a student-housing office turned you down after a VeriFirst background check, the report behind that decision is a consumer report under the Fair Credit Reporting Act. VeriFirst is a Chester County, Pennsylvania screener — in our own backyard — and it belongs to a corporate family better known for debt collection. Neither fact changes your rights: you can see the report, dispute it free of charge, and recover what an error cost you.

What VeriFirst is

VeriFirst Background Screening, LLC operates from West Chester, Pennsylvania, and was formed in 2004 according to its Better Business Bureau profile and its own company page. It is a wholly owned subsidiary of BYL Companies, the West Chester group whose other units include BYL Collections and Enterprise Recovery — debt-collection businesses of the kind our debt collection practice deals with every week. VeriFirst announced Background Screening Credentialing Council accreditation in September 2019, described itself as a consumer reporting agency in that announcement, and sells criminal-record searches, identity tracing, employment and education verification, driving records, drug testing, credit reports, international checks, E-Verify processing, and tenant screening for student housing and multifamily properties, integrated with applicant-tracking systems such as iCIMS. When it assembles those records and sells them to an employer or landlord, it carries every duty the FCRA imposes.

Where these reports go wrong

A name-and-date-of-birth match can attach a stranger’s conviction to your file — the same failure that produces a mixed credit file; a charge that was dismissed can be reported as pending or as a conviction; an expunged record can surface from a stale database; a non-conviction older than seven years can appear even though the FCRA bars it. On the tenant side, an eviction filing that was withdrawn or settled can read as a judgment against you. And a company that does not publish a formal dispute procedure leaves applicants guessing about where to send one — which is the point of the next section.

How to get your report and dispute it

VeriFirst does not publish a dedicated dispute page, form, or turnaround. Its privacy policy says to contact the company to obtain your consumer report or to verify your identity in order to dispute it, and its contact page and BBB profile give the channels: phone (800) 891-6024, email Support@verifirst.com, fax (610) 840-8139, and mail to VeriFirst Background Screening, LLC, 1554 Paoli Pike #311, West Chester, PA 19380. Send the dispute in writing so that it is dated, identify the exact item, attach the court disposition or records that prove your point, and ask for written confirmation that a reinvestigation has been opened; the FCRA does not depend on the company publishing a deadline — it has 30 days to reinvestigate and must delete what it cannot verify. The employer or landlord that ordered the report must give you a copy before acting on it. Our guide to disputing a background check covers what the letter should say.

When it becomes a legal claim

Consumer reporting agencies must follow reasonable procedures to assure maximum possible accuracy, reinvestigate disputes, and delete what they cannot verify. A stranger’s record on your report, a dismissed charge reported as a conviction, or a dispute that goes unanswered is the exact failure the FCRA makes compensable: actual damages for the job or housing you lost, statutory and punitive damages where the violation is willful, and attorney’s fees, which is why we handle these cases on contingency. VeriFirst is a Pennsylvania company, and Pennsylvania is our home court. It sits alongside Justifacts, Truescreen, and the other companies in our background check company directory; its tenant reports fall under our tenant screening report errors practice, and our background check error lawyer practice covers the employment side, including when you can sue a screening company.
